Terms of Service
Last updated: 31 August 2026
These Terms of Service (“Terms”) govern the provision of website design, build, hosting, and support services by Quin to clients. By engaging for services, you agree to these Terms.
1. Services provided
Quin provides website design, front-end build services, website hosting, and ongoing maintenance, updates, edits, and support for websites. Services may include concept development, design direction, page layout, responsive implementation, content structure, launch support, and post-launch updates. I may also provide hosting through Cloudflare or other approved hosting services when required.
2. Scope and communication
The scope of work will be agreed in writing before the project begins. Any additional work outside the agreed scope may be billed separately. I aim to communicate clearly, but timely feedback and approvals from the client are required to keep projects moving.
3. Project timeline and client responsibilities
Proposed timelines are estimates and depend on timely feedback, content delivery, access to required materials, and prompt communication. Clients are responsible for providing any copy, branding assets, images, login details, and approvals needed for the project.
4. Fees and payment
Fees for website design and build work are agreed before work begins. Hosting and support are billed on a recurring monthly basis, unless otherwise agreed in writing. Payment terms will be confirmed in the relevant invoice or proposal.
If a project is paused, delayed, or cancelled after work has started, fees for completed work and any committed third-party costs may still be payable.
5. Hosting and support
For hosting and support plans, Quin provides website hosting, maintenance, updates, fixes, and ongoing support as specified in the service agreement or monthly package. This may include small content updates, design changes, maintenance tasks, and technical fixes within the agreed support scope.
Larger redesigns, major feature development, new pages, or extensive rebuild work may be treated as additional paid work outside the standard support plan.
6. Ownership and intellectual property
Quin retains ownership of its pre-existing templates, design systems, methods, and tools, unless otherwise agreed in writing. Client-provided content, branding, imagery, and copy remain the property of the client where applicable.
Final design work produced specifically for the client will generally be considered part of the commissioned project deliverables, unless otherwise agreed in writing.
7. Website content and third-party materials
Clients are responsible for ensuring they hold the rights to any text, images, logos, trademarks, content, or other materials supplied for the website. Quin is not responsible for checking copyright, trademark, or licensing issues unless explicitly engaged to do so.
8. Warranties and limitations
Quin will perform services in a professional manner consistent with reasonable industry standards. However, I do not guarantee that a website will achieve specific business outcomes, ranking results, or conversion levels, as those depend on many factors outside my control.
My liability for any claims arising from my services is limited to the fees paid for the relevant service, unless otherwise required by law.
9. Cancellation and termination
Either party may terminate a project or support arrangement in accordance with the agreed written terms. If a service is cancelled, any work completed and any committed third-party costs will remain payable.
10. Confidentiality
Quin will treat client information as confidential and will not disclose it except where required by law or necessary to provide the agreed services.
11. Governing law
These Terms are governed by the laws of New Zealand, and any dispute arising from them will be subject to the exclusive jurisdiction of the courts of New Zealand.
